Effective June 11, 2026. These Terms of Service (“Terms”) are an agreement between you and ABJ VENTURES INC DBA PLAYA EBIKES (“Playa eBikes,” “we,” “us”), 203 Corral Rd, Nixon, NV 89424. By checking the agreement box at checkout, placing a reservation, or using this website, you accept these Terms.
1. Eligibility
You must be at least 18 years old to place a reservation, sign a rental or purchase agreement, or ride a Playa eBike. By reserving, you confirm you (and every rider you assign) meet this requirement.
2. Reservations, Payment & Fees
All orders are paid online and collected by self-pickup in Nixon, NV — we do not ship, and we do not accept payment at pickup. Each eBike reservation includes a $50 non-refundable booking fee. Prices, deposits, and applicable Nevada sales tax are shown before you pay. You represent that you are the authorized holder of the payment card you use.
3. Cancellations & Refunds
Cancellations are governed by our Cancellation, Deposit & Return Policy, which is incorporated into these Terms. In short: full refund minus the $50 fee through July 31, 2026; 50% August 1–15, 2026; no refund on or after August 16, 2026 — per eBike. The deposit hold is never charged upon cancellation.
4. Rentals — Deposit, Return & Rent-to-Own
Every rented eBike carries a refundable security deposit equal to the difference between its purchase and rental price, pre-authorized as a hold on the assigned rider’s card before pickup. The hold is released after the bike is returned by end of day September 8, 2026, working, complete, and clean. A bike returned inoperable, incomplete, late, or not at all converts the rental into a purchase and the deposit is charged — our recovery is capped at the deposit. 5. Purchases
Purchased eBikes are sold AS-IS for use in extreme conditions; use at Burning Man voids the manufacturer’s warranty. Mechanical-defect remedies are defined in the signed Purchase Agreement.
6. Required Pre-Pickup Steps & Multi-Party Orders
Before pickup, each assigned rider must sign their agreement bundle (agreement, liability waiver, card authorization, identity consent) and complete the steps in their reservation portal. Where the person paying is not the rider: the payer authorizes the purchase price and acknowledges that each assigned rider signs and remains fully liable for their own eBike; a designated pickup person acts solely as the rider’s agent to receive the bike and confirm its condition. Only the signed rider may ride.
7. Assumption of Risk
Riding an eBike — especially in the conditions at Burning Man — carries inherent risks, including serious injury. Playa eBikes provides no insurance. Each rider’s signed Liability Waiver & Release governs; nothing on this site replaces it.
8. Communications & Media
By providing your phone number and email, you consent to receive transactional and operational messages from Playa eBikes regarding your rental. You also consent to Playa eBikes capturing and storing timestamped photo and video media of you and the eBike at pickup and return for condition verification and dispute resolution. If you provide another person’s contact details (a rider or pickup person), you confirm you have their permission for us to contact them about this reservation.
9. Privacy
We collect identity documents and contact information solely to operate reservations and prevent fraud. Government-ID images and driver’s-license numbers are retained for 12 months following the end of the 2026 event, then deleted. Card numbers never touch our servers — payments and deposit holds are processed by our payment provider using secure tokens. See our Privacy Policy and Cookie Policy.
10. Acceptable Use of This Site
You agree not to misuse the site, attempt to access other customers’ reservations, or interfere with its operation. All site content and branding belong to Playa eBikes and its licensors.
11. Disclaimers & Limitation of Liability
The website is provided “as is.” To the maximum extent permitted by law, Playa eBikes is not liable for indirect, incidental, or consequential damages arising from site use or a reservation. For rented equipment, our recovery from you for the bike itself is capped at the deposit as described in Section 4; your responsibility for harm to third parties is governed by your signed waiver and indemnity. Nothing in these Terms limits rights that cannot be waived under applicable law.
12. Indemnification
You agree to indemnify and hold Playa eBikes harmless from claims arising out of your use of a Playa eBike, your violation of these Terms, or your violation of any third party’s rights, as further defined in the signed agreements.
13. Dispute Resolution — Binding Arbitration & Class-Action Waiver
Please read this section carefully — it affects your legal rights. Before filing any claim, you agree to contact us at info@playaebikes.com and allow 30 days to resolve the issue informally. Any dispute that cannot be resolved informally shall be settled by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Washoe County, Nevada (with remote/video participation available). You and Playa eBikes each waive the right to a jury trial and the right to participate in a class action. Either party may instead bring an individual claim in small-claims court if it qualifies. Arbitration fees are allocated per the AAA Consumer Rules.
14. Governing Law & Venue
These Terms are governed by the laws of Nevada. For any matter not subject to arbitration, the exclusive venue is the state and federal courts of Washoe County, Nevada.
